There is a great misconception that Section (xxix) of the Constitution "external affairs" is an allow all and everything to allow the Commonwealth of Australia to engage in environmental treaties and then legislate accordingly (consider High Court of Australia re Franklin Dam) This is a misconception as the framers of the Constitution made clear that "external affairs" was limited to what elsewhere was already provided as a constitutional legislative power and no more.
Therefore, environmental issues not specifically a constitutional power therefore is and remains beyond constitutional power and any legislation therefore ULTRA VIRUS.
